When the court has to decide on custody rights do they consider things like whether the parents were married to eachother and circumstances surrounding the conception of the child? I was travelling in Guatemala on an insurance settlement and was locked out of my accommodations one night. I let one of my companions (a Guatemalan citizen) for the evening walk me to a hotel. I wouldn't have wanted to stay there alone (it was very funky) and he came in with me. Supposedly there was only one room/one bed. Anyway I came back to the U.S. and realized I'd gotten pregnant. I had not been sexually active up to that point for over a year, had never wanted or desired children or marriage up to that point. The whole thing was traumatic, but my daughter is 7 now and she's awesome. Her dad is crazy about her but we disagree on many things philosophically. He's not very educated. He thinks he should have 50% say about everything. If I get an attorney might I have a chance to get sole parent rights and be in control of all decisions? He's living in the states now, works full-time, but is married to a U.S. resident while living with someone else. My daugther has always lived with me but is just now visiting him for an extended period. The visit is going really well and now he things she should live with him.
