I really don't know how to start this but I am going to try my best. I am getting married here before long and I don't want my son growing up with a different last name than mine I was wondering if my boyfriend the man I am getting married to can adopt my son without his real father saying so. See the thing is that my son's real father is not in his life he hasn't made contact with me since september and my son is 3 months old now and the only man he knows of his dad is my boyfriend do we have to has his real fathers consent so he can adopt him even though he is not in my son's life or can we do it without his consent please help I am confused

Hi Kaden's Moma,
Sorry but no he can not adopt your son without the fathers concent unless his father will give up his rights, same difference. Until he gives up rights to your son he will always have them.
If you are concerned about last names you can always keep yours and add the new one instead of totally changing it.
Congrats on getting married.

In Az the father's rights must be severes before you can have youe new spouse adopt the child... Contact your County Attorney and they will be able to tell you what the law is in your state.

Thanks for the advice, I know in my state which is Ga. That when the baby's real father's name isn't on the birth certific that he has no rights to the baby. And Kaden's real father was not there for the birth and didn't sign the birth certific either he has not made any contact with me to find out anything about his son and i honestly don't care if he ever does because kaden has a daddy which is Kevin my boyfriend

I have a question. I live in the state of Texas. Can my boyfriend adopt my son, even though my son's birth certificate has nothing where there should be his father's name?
Please help.

Sounds like some research will have to be done with that. All I know is that in AZ if you get married during or after the birth the husband is considered the legal father. (meaning if there were no paternity tests done) If the biological father wants a paternity test done, the husband has to give consent. Wierd, but true just looked it up today.

Now, if your ex is not on the birth certificate and no paternity test has been done, there is no proof as to who the father is right? So couldn't you just add your new husband's name on the birth certificate?
