The short story is my soon to be ex-husband and I agreed to a move. He said I needed to find a job in the new place. I found a job and moved to "get settled". He kept our boys. After I started my job, with no money and no vehicle, he filed for divorce. He now has temporary custody. He is now saying I abandoned them which is not true. I do have an attorney but want some advice from others that have been through it. What helped you?

He was mentally abusive. How can I prove this? What can I do to get custody? He is emotionally abusive to the boys too. They get in trouble for telling me things that go on. He yells and cusses at them, and I mean bad.

I'm sorry you are going through all that. Just stay calm and you can get a temp time set up with your kids. Just do that ASAP before he uses that against you too.


That seems such an underhanded thing to do, and that maybe a clue that he had declaired war.

You may want to think about moving back, [closer to the kid are] if you can so to fight the court battle thats called divorce with an underhanded player.

Well you are going through a tough time and i hope all goes well for you...hang in there good things come to those who wait...i wld bug the house and record the conversations some phones can that might help out...
well stick around i know there are ple here who have gone through similar situations and will offer better advice and my prayers are with you and your boys.

Welcome to SFV. Sorry to hear that this is going on. As Robin said take action now so that no more time goes by. For now he only has TEMP custody and you will have your say in court before anything permanent is decided. Just tell them your side as you stated here.

I dislike even saying this but, you may want to think about how you present your side in regards to the emotionally abusive stuff. Knowing how difficult it has been for some of the members that I've seen in here that were trying to prove/fight against abusive situations in court, it might be harder to show the court that your plan was to relocate together as opposed to you just moving to get away from him. Your call and something you could/should talk over with your attorney.

How long had it been since you moved that he filed for this stuff?

Oh, another thing I like to add when I see any mention of taping phone conversations as blkbeauty said. http://www.rcfp.org/taping/
That will include state by state guidelines. A great tool, but only if you can do it legally Wink
