I am married to a man who dated a woman, they broke up, she found out about a month later that she was pregnant, she moved out of stat while pregnant, and now the child is 1 year old and they are STILL trying to work out a visitation schedule. He filed paperwork as soon as the child was born asking for child support and visitation to be set, and they are just going to court over a year later to settle this matter because that was the first date available. He has paid child support without a court order from day one. Anyway, he has made several trips to see his daughter and is making another one right before court, and he wants his visitation in FL after he goes to court, where he lives, and the mother wants to restrict visitation to AR, where she lives with no overnights until the child is 5 years old, even in AR. To be clear, no there is no reason to think the father would hurt or neglect the child in any way, no drugs, alcohol, ect. He is a good man and there are no real issues in that department. The mother even says she thinks he is a good father, when we had a deposition recently. She plans to site abandoment issues in court that may result from the child staying with its father for 4 days at a time without its mother, and the long term effects it could have on a child, in order to keep visitation in AR and as limited as possible. Does anyone have any documentable info on this issue, one way or another? I can't seem to find anything online. Any idea as to how this may hold up in court?
