The continuing saga..
OK, sent demand letter which was received via certified mail to NCP (noncustodial parent)approximately two weeks ago. I gave him two weeks after receipt of letter to pay.

To reiterate-- I have been trying to get him to pay for medical bills paid by me for the care of our son, 2007. He is legally required to pay 78% which is around $2000.00 so far. $250.00 of the bill is half the cost of a plane ticket that I purchased so that our son could fly out to visit his father last summer. Father promised to pay that asap immediately. He saw his son but never paid for the ticket.. and had his son work for him all summer long.

Anyway... he called and left a message a couple of days after receiving the demand letter and said that we needed to talk about this and there is no need to have the additional cost of attorney fees involved. Of course, I never called him back. Why should I?
He called in December after I sent a third bill!! and said that he would give me a couple hundred a month which I never saw; hence the demand letter. Sure it is alot of money, but I had to take out a loan to pay for a medical procedure- wisdom tooth extraction, last May and am paying interest. His father has never called or explained or anything until I started getting rough about it.. I think I will give him another week just to see if he sends anything and then go to small claims which I have to do through his State county office that is 1300 miles away. I am not sure whether or not to have CSE switched to my state which would probably make things easier on me but I do not want anything to get "messed up" on the switch. What a pain!!

One thing my EX is very good at is loosing all his records and going off of what he recalls (whatever is convienent to him of course). Anyway, I've gathered up my reciepts for the past 10 years and it amounts to about $12K that he owes me for 1/2 of medical expense and about a year of health insurance premiums I paid to add 2 dependents to my insurance plan.

I'm lucky my state doesn't put a time limit on medical claims.

Anyhow, I'm caught between even doing the whole thing since... it's just money and I've learned to be independent with children on my own. The children care about him, but he has become a stranger and the more they get to know their dad... they don't seem to appreciate him. My youngest even wants me to date so he'll have a chance to have a dad.

On the other hand... a lawyer I found suggested to time the claim right when he recieves a bonus which would eliminate the need for monthly payments. Of course the lawyer would take 1/2. Soooooo.... I'm asking myself if it is worth it.

Can he understand if I choose not to persue this I refuse to acknowledge him as a person anymore?



Anyway.... IMO, I would check to see what the laws are in the state you are residing in. I would imagine since you live there you are suppose to transfer the case anyway.
