So im 19 yrs old, the father of my 9 month old son is not paying child support as of right now, so am i forced to let him see him if he wants to if im not receiving child support as of right now? I figured since im the one supporting him, and im the primary parent, until i receive child support, can i not let him see him legally?? Frowner
I dont want him to have anything to do w/ him, but i know i dnt have much of a choice... but until child support i was hoping everything was pretty much my decision...

WElcome to the site Young Mommy...I don't know the U.S. laws or agencies, but if you wait a bit, others will participate in teh forum and give you some good advice where child support are concerned..

Unfortunately, If there is a court order that establishes scheduled visitation you need to comply and allow the sperm donor to see his son. On the other hand if there is also a court order for child support and he is not paying. He is in comtemp of that court order and in certain situations can serve (depending on local/state laws) 15 days or more in jail for failing to provide court ordered support for his son. So, if you don't have an order...get one ASAP (as soon as possible)! If an order exist find away to get him back in court so he can answer to the Judge as to WHY he is in comtempt of court. That's what I would do in your situation. Bye the way you can also have the court make him pay for your Legal/Attorney Fees (depending on local/state laws). Good luck!!

You need to go to court and get an order of child support if you do not have one and if he does he is in contempt of court and you need to go back to court. Also some states will make him pay for your legal/attorney fees. Just keep your head up and think positive.

NO, but you can file an order of contempt and have him arrested so he wouldn't see your child because of being in jail. The custodial parent has an obligation to respect and court order in place, so if he is legally bound to visitation, then you must provide it. If there is no court order in place, you could legally get away with this but courts frown on custodial parents that do not give access to non custodial parents to their children witout just cause (endangerment of child, history of abuse, etc...)
