I came to this sight looking for advice or help, my daughter's father was incarcerated when I was 7mths pregnant and was not released til she was 5 turning 6, he then returned back and will now be getting released this December and is talking about filing for custody. I need to know what my rights are and should I file for full custody of my daughter to prevent me. Can someone shed some light on me?

Have you thought about contacting legal aid they are a low income place to help with legal questions and legal situations. I would contact them in your city and talk to them about what you should do, the problem with this question that it really depends on what state you are currently in, each law varies
from state to state.

In some states you dont need a custody order in some states you do need a temperary custody order and the child is considered fair game until it reaches the court system. Like I said contact legal aid and check it out, they will know the laws and what you need to do.

As far as a fighting chance of getting custody
the judge has to be smoking crack to give him custody. With his track record of being locked up several times.

I tried legal aide and I am over income, so now I guest my next step is to contact a lawyer. I think he would have to prove me unfit. But I don't even want to have to go threw the courts or anything. I feel as though he should have no rights to my child, and when she is old enuff to understand I will let her make the decision of having her in his life. But I just got worried about the thought of him even trying to take my baby away from me.
