my son has recieved 10 dollars in 2.5 years from his father,who,when i asked for this money he told me to bring my son and drop him off and he would take over from there. and now we are finally in the works of getting to the actual establishment of paternity and now he and his new 18 y/o wife are saying after paternity is established they are going after full custody...my son knows neither of them and he has never shown any interest except avoiding us and avoiding having to pay anything. He gave 2 children up (now age 6 and 7,with whom i spend more time than he does) for adoption after a lengthy case involving dcfs...he just gave up....does any one know if they have ever granted someone rights after failing already?i will never let this happen...he uses drugs and alcohol daily and his wife wants my baby so that she can get money!!Help!I am a good mom to my son and he needs me....cant afford an attourney....will add more later....thanks!

Welcome to the forum. It's not so much about what took place with the other kids before as it is about this child now, so under the right circumstances, he wouldn't automatically be denied custody.
But now, with that said also know that judges are not likely to disrupt a current home/living situation for a child as long as it is a good environment. Basically he would have to prove you an unfit mother to gain custody, and prove that he was a fit parent, so much for those right circumstances Wink Plus since he hasn't been supporting the child all this time, his motives will be questioned anyway. Just because paternity hadn't been proved prior to this for support purposes, if he was really concerned about the child, he could have asked for paternity to be established after birth.
So.....chances are you won't have to worry about him getting custody.

...yes I provide a consistent and loving home and always have made sure the "father" knew his childs whereabouts...he has had so many chances to say to himself, "I CAN STEP UP TODAY", but he never has...he doesnt work ,nor has he ever worked more than six months his whole life(his father supports him and their new baby and went ahead and adopted his first two children so he didnt have to grow up)I have always initiated contact with his siblings and always been predictable and used common sense (e.g. wouldnt let him take my child out of his carseat when he had a beer in his hand etc.)My son is safe with me,dad or no dad, and that is the way it needs to stay.I am confident that the courts will,if he trys,put him in his place.He just really has alot of nerve!I have been so shocked of all this that I knew I belonged in this forum the minute I landed here.Thanks for your help and I look forward to sharing my past and present experiences in order to help anyone I can... Thanks~
