I have sole physical custody of my daughter. I have been through alot since october with the ex harrassing, stalking and threatening me. He has been in jail twice for it. So the current visitation was overruled by a judge until the court dates are set and the hearings are over. I need to change the visitation to being supervised by a social worker or something of the kind. It was supervised by his mother before and she would leave most of the time. Anyone know if Pa has centers for this sort of visitation? I also want an environment where my daughter can feel comfortable.
Do I need to contact my lawyer to change visitation or go to family court or what? I have never changed it because he just wasn't allowed to see her or showed little to no intrest and wouldn't make a fuss about spending time with her. They haven't seen eachother since the end of september. Just thinking to the future because the court dates are approaching. Any advice would be helpful!!! Thank you! |

What court dates are coming up, is it for visitation modification? If not you need to file specifically for visitation modification with the court that the current order is through.
You might want to at least get a consultation with a lawyer in your area, before filing the papers. They should also have knowledge as to what/if any supervised visitation options are available for your area. |

the court dates are for the charges against him: harrassment stalking terroristic threats and disorderly conduct.
I guess I need to get the modifiction papers from a lawyer. Anyone know of pro bono services in pa? I don't want to put up the 2500 i had to before to go through the lawyer i had to file for custody. I got 1800 back but he requires that first. |

Hopefully someone from PA will know some more for you. Might want to google up your county website and read through there as well, might find some useful stuff.
Here we have a facilitators office at the court house, that we can get the necessary paperwork and they even double check it after we fill it out, before we file it with the court clerk but they don't represent us in court. That's how I did custody on my daughter and then represented myself in court. |

These charges are criminal charges. What you are asking about it is family law. I'm not a lawyer but I suspect that you would have to apply for visitation modifications through family court. It is not likely that the family law aspects would be modified at this hearing. That is not to say he can't be court ordered (sentenced) to no contact as the result of the criminal charges. Take Don's suggestion and consult a lawyer about family law proceedings. If he is found guilty of the criminal charges, it may be very cheap for you to get modifications. |

I'm going with the guys about consulting a lawyer, adding your victim advocate to it. When I went to change visition and determined that I wanted supervised, my victim advocate was a wonderful source of information. She walked me through every step and attends every court date with me. Do yu have both physical and legal custody? That could make a difference though I'm assuming in the situation the answer is 'yes'. Also the person supervising visitation should be at YOUR choice noone elses and should be someone you and your child are both comfortable with. Good luck and keep me posted

First I would like to thank you guys for responding. It is great to know I will get some great advice when I post.
Angiesmom-I have sole physical and we have joint legal. Our mediation was over a year ago and he wasn't doing that bad then. I guess you guys would suggest that I get sole legal too? How much of a say can he have if he is incarcerated or on parole!? Jaysdad-He was ordered no "criminal" contact after he was arrested and we had the first preliminary hearing, then when he got out he called me alot in the middle of the night and was put back injail and had another preliminary hearing. This time they ordered no contact at all. I guess I'm not sure how long that is in place. I am aware that they do not address custody agreements in criminal court. |

ACP -- with the criminal history, it shouldn't be too hard to get sole legal custody as well. I have both and her Dad really has no say whatsoever in anything to do with her (which in our favor, hers and mine). Sit down with the victim advocate and lay everything out, she/he will be able to give you the best guidance in this but IMHO you and yours will be better off going for sole legal along with physical.
