I am New to SFV

All, I'm new to this so please forgive my mistakes.
I've remarried and I live in the US with my new husband, my 2 kids and his 2 kids. My son is 16 so he applied for a passport as an adult but I have to apply for my daughter. Her father went back to live in Italy, has not sent 1 penny in child support and doesn't want anything to do with me. He did, however, sign a document in front of a notary that I have sole custody of my daughter. So now, Passport Canada will not recognize this document but USCIS did therefore we both have our Green cards. Ridiculious! The person I spoke with at Passport Canada said that I need a judgement from Ontario Courts that I was granted sole custody on my divorce date. I'm stuck now. I want to appeal this decision but I don't know how. Does anybody have any experience with this? Will she have to wait until she's 16 to get a passport? Help?
