My husband went through legal aid to get a divorce from me. I got the papers I had to sign today in order that they can draw up the papers he has to file with the court to get a court date. They don't say anything about child support, he filed in Oklahoma. I'm wondering why? I can't ask them because they're representing him and aren't the nicest people in the world. I'm not sure why they don't say anything about me getting any child support..... do any of y'all know why?

Child support, child custody, and divorce settlements are THREE separate issues. You have to file a separate case for each. If you file all three together you can probably get them all settled at the same hearing. If your ex filed the divorce, more than likely, he chose not to file the child support paperwork (are you really surprised?). If you want child support, GO GET IT! nothing is stopping you!

I had no idea that it worked that way. I know we both signed a paper that said that he'd pay 150.00 a month for child support. hah. I had to agree to 150.00 a month and no more or he would have refused to get the divorce even though he's the one that filed. Anyways, I just couldn't figure out why, if I signed that, I was getting new paperwork that only talked about custody. That makes sense now. Thanks for explaining.

That paper is pretty meaningless without a court order. You can contact your local CS office and they will start the case FOR you, just provide basic info and they will do the rest. In a few weeks you will get the judgement in the mail. If he has been supporting you and your daughter up until now, I'm sure $150 a month is not going to cut it now that you are split up. good luck. Don't let him pick your future, YOU choose it!
