Do emails and/or saved IM or Text msgs exchanged between my ex and I hold up in court as far is doing something different than the parenting plan or divorce decree state?

He says it does... I think he is trying to intimidate me...

I can't imagine an email agreement 4 years ago is a legal document...

Do you know?

I've heard of emails/txt msgs/and IMs showing up in court mainly to recieve a restraining order or to win full custody cases.

I'm not sure if your state will validate an agreement instead of the state's parenting plan. You might want to check into the laws in yours state. your CSE office will have information you could probably look online for.

If it's not signed by a judge and filed as a court order, it doesn't mean too much in the grand scheme of things. If you were to go to court for that agreement you could also easily turn that court appearance into a modification hearing to ask for something entirely different based on the present circumstances. Actually.....that's probably the best thing to do anyway since you were in agreement about this 4 years ago but not now. Get a current court ordered visitation agreement since there is a problem now.

Don is right, if the agreement was 4 years ago its not likely it will stand up to anything since 4 years is a long time for things to change.

But I hope that you do know that IMs/e-mails/text messages are just the same as written letters and can be used in proceedings so its important to keep copies of everything but to also be very careful of what you say.
