I go to court in a little under 2 months for child support, and it's an IV-D/Des case, not a private one. I read that unless his father requests custody of some kind, then I'll automatically be awarded sole custody. What I am unclear on is whether he can request it while we are there in court, for us to duke out right there, or if he has to file and take me back to court on a seperate day to get it. Does anyone happen to know? Confused

As far as I know, he can request custody in court. However, I am in Canada and dont know if the law is the same there. But word to the wise... be prepared if he does go in there requesting custody as well. Just in case.
