My ex's wife just showed up with my 5- and 7-year old children both in the front seat, then she pulled their booster seats out of the back of the Suburban. When I sent an email to my ex about this concern, he told me to stop harassing his family. What can I do? In my email I threatened to call CPS if it happens again--it's been an ongoing concern, not like every time, but it happens a lot. (Several months ago I also had major concerns about his then 13-year old daughter driving the truck with my kids in it--the same threat worked pretty well in stopping that.) Whenever my kids are with their dad, and I hear a news story about a "deadly car accident," my heart stops. I have to admit he is a pretty good driver, but he just doesn't care about safety.

I don't know how much it varies from county to county but DHS has shown no concern whether kids are in a car with an under age driver or not in buster seats, they told me it is a DMV problem.
If you can document it, it would be a reason for not allowing visits but it will land you in court. At that time you might get the parenting plan changed. My ex has denied me parenting time for less good reasons and got away with it. But now I have emergency custody, which is another story. |

WTF?!?!? Why would anyone not put children in booster seats/seat belts. I hate stupid people!
There was a new law passed in Michigan that states that if children are under 4'9" and/or 80 lbs, they have to be in a booster seat. I still see morons driving around with kids in the front seat, no seat belts or are turned around in the seats. Sometimes I want to become a cop just so I can pull over those idiots and ticket the **** out of them. I would also be calling DHS. I have almost called DHS on a few people that I have seen that don't have children buckled up . . . Anyway, sorry for the rant . . . I hope you can get something resolved the easy way about this. |

I'm not going to argue about the safety benefits of car seats and boosters but I wouldn't blow it out of proportion, I know is something to say in court but you know what, we didn't even have seat belts when I was growing up nor I wore a helmet riding my bike and I used to climbed up the highest tress that drove my mom crazy.Laws are good for the safety of our children but, let me put an example: If they got you riding you motorcycle without wearing a helmet in California the treat you like you are a criminal or at least nuts, now that I moved to Texas we are sane, no helmet law.
