Well my EX goes to court today for Child support. They are charging him with contempt of court. . I filed back in Decemeber of 2003 they ordered him to pay 60/week TOTAL for 2 kids ! ! Anyway he went forever w/out making a payment . . He has since made a 75.00 payment back in September of 2005. . . Long time w/out anything being done. I just dont feel that it is right to not help out a little ! He called me to tell me about his court date ( which I already knew) but he called me to yell and scream at me to ask me if I have messed up his life enough ? ? WHATEVER ! ! He then asked me to go to court to speak on his behalf to tell them that he does help me out with money ! Yeah right ! I am not that stupid everytime that I go to him for something that they need he tells me that I took him to child support for that and that I am not getting a thing from him. . . Well then I guess that you can go to court and see what happens. . . he is working and they found out (it was a little bird!) and stated that they are going to start taking 150.00 per pay out of his pay check towards c/s. . . He said that he was happy about that at least he knows that it is getting paid. . . But he calls this morning to tell me that he will call me when he gets out of jail and to give the kids a kiss for him since he wont be seeing them for awhile . . Anyway if anyone has been in this situation can they really sentence him to jail time if they have put out a lien on his paychecks ? ?

like with all family law it goes by state, but yes they can put a spose in jail. I never figured how someone was going to pay back child support if they are in jail, but so goes the justice system. The one thing I would focus on though is the fact that he is the one who chose not to support his child. there has to be a punishment I beleave, barring extenuating cercomstances. Lets face it, $60 a week will barly feed two kids, let alone cloaths, ect.

I get $776 a month for on kid. It is barely enough.

Don't feel bad for him at all. He did this to himself. Heck, if is working at McDonald's he should still have enough to pay $240 a month. Unless he has been in a coma, he should have been paying.

Do ask yourself though, has helped the kids and you. When you ask for money - does he say no all the time or are you just angry?

I doubt they will throw him in jail after his first court date. They will give him chance after chance after chance. Especially if he is working and they can garnish his checks.

Speaking of which my ex did not pay me this month and he just left for a three week vacation in the Virgin Islands with his girlfriend. Talk about stupid. Here I am working two jobs and going to school and he gets to go on 3 week vacations, but remember to send me the check.

Okay so do you know if he is in jail on the contempt charge also known as Rule to Show Cause - this is to answer to the courts why you have not paid your child support. Usually when they are found in contempt and go to jail the judge will set a bond. When they post the bond the bond money is sent to CSE and then on to you. Call the SAO and ask them if this was done
It is to your benefit to attend all court hearings. This gives you the opportunity to speak with the SAO before court so you know what is going on and ask the SAO to ask the judge for a pmt on the spot or go to jail till they post a bond. If you don't mind me asking what are his arrears? Is he ordered to pay currant support only - or does he pay something towards arrears? Does he carry medical insurance on the kids? If not and you do does he reimurse you a percent?
I live by Joliet, but when there is a court hearing in Chicago I take the train downtown to attend. This has paid off for me. I strongly encourge you to attend, even if they say you don't need to. Stay active in your case, learn the laws in your state on CSE.

Hey Amanda, the ex and I went back to court this past Sept and he didn't show up. Contempt of court....arrest warrant issued but here in Tx its not like u can call the police and say ok...my ex is at such n such address right now go get him. Here its either if he gets pulled over and they find the warrant...they will arrest or if/when he goes to renew his liscense, they will arrest him.

Amanda, actually you can call the police depart and ask to speak to the Warrant Officer. Tell him that you want to confirm that they have received the body attachment, warrant or what ever its called in your state. If they have received it that is great, if not you might want to call the SAO or your attorney and ask them to fax a copy to them. Believe it or not these body attachments don't make it to the police dept for weeks, months - another oh I'm sorry, not sure what happened.....You may also get their fax number and fax them a copy along with a letter that includes information on your ex such as
verifing home address - what time he leaves for work what time he comes home, where he works, where he hangs out, even would be helpful to supply them with a picture. I know this sounds crazy given the fact they can get a picture from his DL but sometimes they are lazy or it is not top priority. The easier you make it on them the more apt they are to move.
Its true what you said about they usually wait till he's pulled over run his DL and see if there is any open warrants before he is arrested, but you can ask, beg for help. I have done this and it has worked for me and is well worth a shot don't cha think? Are they asking for him to post a bond? That money should come to you - tell the police department that you need some child support and this is the only way this is going to happen.

He called me to tell me that he got it postponed. WHATEVER ! I dont believe it ! ! I dont think that he even showed up ! I tried to call the clerks office at the court but I need the case number to find out anything and I dont have that on me ! I then called C/S back they told me that they received a letter from his employer and they told them that he has NEVER worked for them ! How can they do that ? ? I was told by C/S to call there to see if he was there and to let them knpw what they told me ! Well I did and they told me that he NO LONGER WORKS THERE ! I cant believe that this is happening to me ! Yes if he did get a post ponment I am going to the next one and I am telling everything ! I know that he doenst work under his social . . . It is frustating no matter what info I get some how he slips right thru the cracks ! It is not fair ! ! I bust my tail everyday to keep a roof over their heads, clothes on their back and NOTHING ! ! Everytime that I would ask him to help me out he told me NO he cant help me that is why I took him to Child support ! ! WTF ? ?
He is a piece of **** and I have lost faith a long time ago in the SYSTEM ! ! They are out to protect the wrong ones . . . .

Somtimes I agree Amanda. I am going thru the same thing with boys' dad. When it came time for us to go to court, I had gotten what the state withheld from his income tax check....he thot just cause I got that big payment and he had made a few CS paymts on his own, he didnt have to go to court...WRONG!!

And also, I had found out after the AG's office telling me the ex wasn't workin at a certain job....I called his cell phone one day and the voice greeting said "Hi this is Mike with the CO". I called the AG back and told them about it gave them the cell no. I told them I wanted something done to that company if in fact he was workin there at the time the co told AG he was not workin there. Someone was lyin there....never figured out who, but he was workin there he quit.

It is just a disaster ! My "special" friend doesnt understand how anyone can have such beautiful children and not want to take care of them ? ? I dont get it either ! It is not like they are going to take him dry . . 60/pay . .

DO you have proof that he isn't using his SSN? Do you know what that number is? If so give that to them as well. Even though the hearing was postphoned (if it was) they would have to do a continuance. Try to call the Clerk of Courts or SAO again. No matter how dark it seems now there is light at the end of the tunnel. Remember they can run but they can't hide for ever. My prayers are with you!

Thanks Dawn ! I know it is just so hard after all this time ! Ever since I filed for C/S i have had issues, I filed back in Dec of 2003 . . Well 6 months later they were telling me that I had no court order to prove it ! I went straight to the Govenor. . . He did something about it ! Everytime that I have went to him something has been done ! So looks like I am going that route again ! I wish that I did have the # he is using . . . Maybe it will just appear one day . .

Hang in there sweetie, I hate to see you go through all this. How desperate is your situation. Are you able to feed the kids? Is it extremely tight? Just curious, because there are agencies that will take your case on pro bono if you can prove financial hardship. I know that it isn't fair if you are doing fine, everyone thinks then why do you need c/s? Because you are not the only one who procriated!!!!! Your ex is a f####### D###.

This system is more powerful then the anything the FBI has. After 9-11, the FBI wanted to take control of this system in the name of National Security to track down Terrorists. It was only because the Constitution and Federal law prevents this from happening that it was not done. The FBI Got 2 Billion in 2 weeks to build a mirror system like the one used for child support collection to hunt Terrorists inside the US. Another record for Congress. The amount of money that was given to Homeland Security is classified and not known.
That should be a little hint of how powerful this Database and network is that CSE is sitting on. They can't find your DB??? Give me a break! They do not want to find your DB because CSE does not have the budget, manpower, and resources to COLLECT the MONEY. That is
why they say they cannot find them. It has access to 60 Billion records.It is connected to all 50 states at ALL levels. It is connected to
every Law Enforcement Agency in the US. It is connected to ALL Federal Agencies. It took 2 years and 2 BILLION to build this system.
Many thought this was TOO powerful for Any one to use. The Supreme Court was so scared that this would be misused that they required
collecting child support or they would rule it unconstitutional.
Congress Agreed to that as well because of their own fears. That is why the FBI and CIA could not use it even when we were attacked. It would take another ten pages to show you all that this system can do. It was the most powerful system built that was not TOP Secret.
Moreover, this type of system was never even thought of because it could not be justified for use inside the US boarders. (Based on cost and intrusiveness and US Constitution.) Of course, after 9-11 happened the rules have changed.

Need a license to work? Own a business? A corporation? Business License? DBA License with the state? Pay Sales tax? Federal Income tax? Newspaper Subscription? In jail? In Prison? Now you get not just fingerprinted every time you are arrested you get a DNA sample taken!!! PO Box? (You must show Drivers license to get one) Federal Income Taxes?

Haven't read all the replies, but my thought is that if he's renegged on child support, let him rot! What so many people don't consider is that if the care of those children was left SOLELY to that non-custodial spouse, those kids would have DIED! No one is charging him with attempted murder.. you know why? Because YOU stepped up to the plate the way every parent should, and YOU made sure those kids didn't starve, had shelter, etc. Screw him and his excuses! If he'd made any effort to support his children (and let's face it, even minimum wage allows for SOME effort on the part of a parent, because their kids should come before themselves), this wouldn't be happening to him. Parents who bail out on their kids deserve jail or worse!
