Hi! I'm new here. The main reason reason I joined this board is because I'm dealing with a lot of "drama" with my boyfriend's ex and his daughter. Things have become out of hand lately and I would do anything for some advice or help.

My boyfriend and his ex have been seperated for 2 years but have not divorced or gone through legal child support orders.

Every month, my bf has been giving his ex 300 a month. They are now in bad terms and she's told him that she has filed for divorce/child support/child custody.

She's threatened to tell the court he hasn't been giving her any money and that she's going to get back support. Is this possible?

Doing my own research, it seems, in the state of CA, child support is due and collected once the case is opened. Confused

Does your boyfriend have receipts or cancelled cheques? He must be able to prove his payments were made.

It's good that you're doing your own research and keep doing it. Welcome to SFV. You may find helpful links in the different forums including the Cali room.

lcbebe, Welcome to the forum. I haven't done much research myself on this so I could be mistaken, but I seem to remember something about being able to get retroactive child support for 1 year for repayment of state aid only (used to be 3 years) otherwise it is from date of filing where repayment of state aid is not involved.
At any rate, as JD said I hope he hasn't been paying in cash all this time anyway.

Unfortunately, he's mostly been giving cash. He says it b/c his ex takes so long to cash the checks he used to give her. I quickly changed that!

He's planning to consult a Family Law Facilitator very soon. Hopefully, we can get this stuff straightened out. Thank you for your help!
