My battle with child support has been a NIGHTMARE in my opinion to say the least. I have had a temporary order since last August of which he walked all the way through. My divorce was final as of December 20th. He agreed to pay $4000 in arrears and approximately $1050/month in child support and 50% medical bills. It is now a month later he is now $5600 in arrears and has paid no money towards medical bills.
Here is the kicker. He is now using the medical insurance of which I agreed to carry because he can't keep a job, and he uses it improperly. He took our daughter to the emergency room, which I told him my insurance wouldn't cover and racked up a $500 emergency room bill. I feel so violated because I am along for the ride on two loans I signed with him, and now he is abusing my health insurance! I need some help on how to file papers to get the income deduction order enforced that I have because he refuses to tell me where he works. I get maybe 100-300 a month when I should be getting $1100 after medical bills. Plus he is costing me more money by improperly using my health insurance! I am tired of him not pulling his weight. HELP! |

Do you have a good lawyer? I think I might just begin there. You can also file at the court house for garnishment of wages. It will take some time but you might have a chance of getting support. Keep the courts informed of what is going on and keep pushing the issue eventually he will end up in jail if he does not pay.
As for the ER he should have signed responcibility for the bill so you should not have to pay anything on it if insurance does not cover it. Lots of prayers. The task ahead of you is never as great as the POWER within you. Judge others only when you are ready to be judged. Ray |

I think Tomany2count has a good suggestion in seeking legal assistance. As an example, an attorney may be able to subpoeana your ex's bank account records to determine where his employment deposits are comming from. He could also conduct what in California is called a debtor's examination where the debtor can be questioned about his income and assets. Failure to answer could lead to jail, at least under California laws. Another idea might be to seek assistance from a licensed Private Investigator. They too may be able to help you locate employment. If I'm understanding you correctly, that's your issue. You have the wage assignment order, you just don't have an employer to serve it on. Lastly, be sure to open a case with your local government child support office. Although they can be exceedingly slow, they often produce results (eventually.) Good luck. Good news is that from what I can tell he actually did turn in the income deduction order. There is a payment in the correct amount posted to the State Disbursement Unit. So everyone cross their fingers and maybe this will be the end of the fight for at least a little while.

Florida Income Deduction Order Template
This is a .pdf form that you can fill out and then submit to the court on your own to have them order your ex's CS withheld from his check directly. The problem is, it has to then be sent to his employer so that they CAN withhold it. In the order, there is a clause that requires the NCP and/or his employer to notify the court in writing within 7 days of a change in address or employer. That may help you, because you can then file contempt of court charges against him. Motion For Contempt Template This will allow you to file the contempt charges on your own. It includes instructions for filling it out and how to execute it. Hope that helps, and hopefully it'll save you money on an attorney you might not be able to afford without CS.
