I know state law says work related daycare is to be split 50/50. However it is not stated in my divorce decree.

Because of this me eXwife says she does not have to pay it. Is she correct?

I would think the law superceeds.

Just so you know. My lawyer said because the divorce papers no not state anything about child daycare the law is enforceable.

Does your divorce decree outline regular child support. I can't say absolutely for Utah, but generally speaking, the law is a guideline for setting up support related issues. But each case may have it's own obligations set up, as agreed to by each party. For an example, the law could entitle certain parties to alimony also, but unless it is stated in the divorce, they wouldn't be able to collect it unless it was ordered in the divorce, even though the law states they are entitled to it. As a single father with sole custody, I am entitled by law to child support from the mother, but I didn't ask for it and therefore could not expect her to pay unless I went back and got a new court order stating that she is to pay that support.

Thanks for your reply.

My divorce does specify child support to be paid by my eXwife.

Becasue the divorce papers did not specify implicitly the daycare expenses be paid by whomever. the law does apply therefore she must pay 50% of the daycare expenses.
