When my fiance finishes University and becomes an RN she will probably be making around $5600 (what the average nurse makes around here now) We've decided that after a year or two of her working I will stay home will our children (none yet) because she will be making enough to support our family without me working. We think it would be better for our children as well because they would be home bonding with me instead of with a babysitter (can never be too safe) My question is what will happen with child support for my son from another relationship when I have no income. We currently have no child support agreement but I do send her money every month and we are working on an agreement now bases on my income but when I become a stay at home dad I will no income. My ex was very nasty to my fiance and never even let her meet our son so I doubt my fiance is going to want to give my ex her hard earned money but I still want my son to get something. Any ideas on how that would work? what would the judge do if my ex took it to court?

You may very well still have a court order to pay support based on what you have the ability to make, previous employment. Normally a new spouse's income is not figured into the equation and it should be the same here.....HOWEVER, it would be your choice to stay at home and again, more than likely (and it's only fair) child support would be figured on previous income.

That sounds good, I hope that is how it works out. I have no problem paying what I am now or even $100 or so more and I'm sure my fiance will not mind that at all. I was just worried that it would be based on her income which will be a lot more then I ever made. I honestly would have to problem giving it to my son, I probably wound't even mind my fiance paying that much but after the way my ex treated her I can't blame her for not wanting to give up that much of her income.
