I want to know if anyone knows anything about this. From about 1997 to about 1999 I received public assistance for my son. Well his father has never paid child support. We have been to court in the past and I still have not gotten anything. Well I seen him recently and he had just gotten out of jail. Now he states that he wants to do the right thing because he is tired of going to jail seeing is believing. We go back to court next month. I want to know if he does pay will most of it go back to the state. For those years I received assistance.

Usually...he would be recquired to pay whatever the current support order is and that goes to you, plus he will have a certain amount added on per month that would go to the arrears, back to the state. Then any tax refunds etc. that they lein would also go towards his arrears.

jayssmom...I know in California they would only take a small portion from the CS check to pay the state back for whatever assistance you received and the rest would come to you. I was on Public Assistance for 1 1/2 years and I still got a portion of the CS money when he was working.

As someone else said, you should certainly get all of your current support first. Then, you should also be entitled to receive arrears that accrued after your last TANF off date.

In California and most states, the county/state is entitled to child support that accrues while you are receiving CASH AID (not food stamps or other aid).

As far as the pecking order for application of pyaments made, you get paid first for current support, then any arrearages that are owed to you, and then county/state gets paid the support that accrued while you were on TANF.
