To keep it short I have three teen sons one ready to go to college. For the past 8 years have received cs way below the guidelines. I have asked my ex on many occasions to help more he makes about 140,000 a year all i get is he will stop paying me and the kids would suffer.I always feel backed in the cornor.Needless to say I finally got a lawyer and my case conferance is in July. Well my kids told me he called the other night and took a lower paying job so I guess all those years missed I'm screwed now! Trying to get a hold of my lawyer she is always busy I'm down right depressed, frustrated and overwhelmed. I guess I'll wait and see what happens but the time is ticking by so slowly and the money is adding up for the lawyer. My ex hides behind his new wife's sister who is his lawyer and my kids still go with out the extras in life! I wonder how he lives with himself

How he lives with himself is the question of the age.

If he took a lower paying job after you filed a modification order then he will come up on the short end of the stick. You can probably get the CS amount set at the income he is able to make, also he might find himself paying your attorney fees.

Received some very interesting lawyers papers from the ex. I have been crying since last night! He has 44 slanderous remarks against me all but a few minor ones are true. He downright lied about everything to make himself look good. All i was asking for is revisited cs and help with my sons college, now i'm on trial my lawyers secretary thought we were going through divorce proceedings I had to inform her we have been divorced 5 years now and she went oh!!!! Tell me something is this normal for a man to pay half of cs for 8 years and when push comes to shove and I finally get the balls to do something about it he slanders me ? Will a judge look at that or will I have to defend myself in up coming court in July??
I need reassurance my lawyer is too busy to talk and I have to wait 3 weks for an appointment, I sometimes wonder about lawyers!

I have had real bad luck with lawyers lately so can't say much there.

In a support modification hearing it should be kept to the facts of when was it last modified, how much he is making or can make, how much you make, and if he has taken a pay cut to avoid paying. Your behavior about anything else has no bearing of support, if he wants to bring it up he needs to ask for a parenting plan change, and that would be a different hearing.

Stay calm, look on the net for CS laws in your area.

has he been short paying it or paying a low amount?

the slanderous remarks, well what revealence do they hold to support and contribution?
If you go before a judge the judge will see if there is any revealence or just bad mouthing.

I never had a court order didn't really knew my rights up until 3 years ago when I tried then he stopped giving my cs checks and then who would house and feed my 3 kids until fro stepped in. He always bullied me b/c his lawyer was his new wife;s sister and she is known around here to lie to get anything at whatever cost. he makes 170,000 a year i just seen on the new papers and I make 10,000 a year he is gone 5 weeks at a time to work and I'm left holding the bag. I don't know anymore but thank all

I know how it feels. I haven't changed my CS for over 10 years when he claimed he was unemployed, his company and his assests dissapeared, and his previous tax return showed a 6 figure income.

I'm in the process of modifying my CS since I know he's employed consistently now. I'm currently drafting an expense report on the boys costs and activities and adding a projection cost on improving the boys life. I really would like my ex to say "NO" to these ideas so that the boys will know that's what he chose instead of saying "well, you never did ask."

Sorry to hear about your troubles also Tess, I don't know anymore I just don't! All I know my ex's sister-in-law is the dirty player and same goes for the ex. My boys know I'm trying and that is all that matters in the end !
