First off your lawyer should easily be able to answer this question, if not get a new one. If he says there is nothing you can do to get the information fire him.
Does your ex have a checking account? You can have bank records pulled. You can have tax records pulled. You can insist on pay stubs from his employer. This is my question. You are now getting $600.00 for two kids is this for a month, week, or what? I know people who have 2 kids and get $500.00 a month for 2 children. I believe in Florida there are guidelines for child support in accordance to both parties income. As long as the $600.00 is within the guide lines you may not get more. The courts say he has to have enough money to live on. I have a girl friend that has 4 kids and receives $225.00 a week for 4 and her ex makes decent wages. I am curious what your lawyers says. Is he saying he is within the guidelines? If so you might be fighting an up hill battle to get any more. God bless. The task ahead of you is never as great as the POWER within you. Hey,
Toomany's post made me think about something: have you filled out the Florida Child Support Worksheet with the numbers that your ex gave you? If not, you should fill it out (it's easy...like 1 page with 6 pages of instructions) and see what the CS amount comes out to be. It might be $600...it might be more or less...but the worksheets are usually very black/white when it comes to assigning CS. Then fill the worksheet out again, with an estimate of how much you think your ex *really* makes. You may find out it's not worth your time to fight for him to be honest... I say not worth your time, because lawyers and the legal process are so expensive (both financially and emotionally), and drawing out the process may not increase the CS enough to compensate. I agree that you aren't getting the services that you paid for from your lawyer, if he isn't answering these questions for you. How easy would it be to switch though? Hey,
I don't think you understood what I meant about the worksheet. I meant that you could fill it out twice yourself, with both his declared and suspected income, to see if the additional CS would even pay for your legal fight. I don't know if your first agreed to amount even means anything in court. Does he admit he ever agreed to it? The worksheet doesn't account for medical expenses beyond health insurance though. There is a lawyer that comes by here, that could probably describe how CS is affected when the child has unusually high medical expenses. He could also probably tell you how he catches employers that lie about their employees income. But really...shouldn't your lawyer have done this for $6k? Later, Bobby |

Hey,
I noticed you'd deleted a bunch of stuff...I figured you didn't want to leave personal stuff on a public board, so I deleted your personal details that were in my posts. I would be interested in what the lawyer that sometimes comes by here says, about how to prove an employer is lying about their employees income. I think it might help you to ask your ex why his expenses are more than his income too...either he's going in debt or he's lying. I'd also like to know how unusually high medical expenses are typically factored into the CS equation. I gotta say, your state's CS worksheet seemed a little goofy to me. I filled it out for my own situation, however, and it came out to $373 a month compared to the $324 that my state gives me. It's funny how all the different worksheets that the states use often come close to the same number. Later, Bobby |

Yeah I deleted some stuff lol, but I did talk to rbb333. He had some great information. I just wonder if I can work with a lawyer and file some paperwork on my own. Because what I meant earlier was CS per month is $640 based on the 20 hours a week my STBX is "working" and it would be $1350/month if he was working full-time like he should be. What scares me is that there is no guarantee if I invest in the attorney to prove more income that 1. The income is provable 100% and 2. if it isn't provable 100% that a judge would order the support based on full-time work. |
