My son's father is retaining an attorney. Yesterday we had our first court date trying to modify his child support award. My son's father is a doctor. When the award was set he was still in his residency, not yet making Dr. style money. Now he is. Since he lives out of state it's taken me a year and a half to get this far.
Yesterday he didn't show, but an attorney who is not yet representing him did. Basically what we know is that he did not accept the service yet. NOrmally Texas tries to do it via certified mail. He's familiar with this and simply refuses to accept the certified mail. So we've reset the court date for July. But my question is, what can a lawyer do in this? From what I understand we are just reviewing the number. Is that right? Or is there more open for discussion? This is a man who has never seen my son. He tried to ask that his parental rights be terminated in the first hearing. The judge didn't like that and tacked on an extra $100 per month. What can a lawyer do for him? |

Oops, I haven't been on in a long time. A lawyer can cost him alot of money, and make you spend more money. Lawyers generally exist for one another, and will try all kinds of nasty things to increase their billable hours. I would get copies of all the court documents where he has tried to shirk his duties, and have them printed in all local papers. I wouldn't go to a doctor like him. You could also make copies and put them on all the cars in the doctors parking lot where he works. The court documents are public record, so it is not against the law, and he couldn't sue you for slander. Shana

Hey Charity~ I assume what he is attempting to do by hiring an attorney is keep the child support the same that it is now. If you have an attorney, it makes sense that he would hire an attorney for representation. |

I'm going thru the Attorny General's office of Texas. They provide me with an attorney to represent my son's intrest. I guess he's learned from last time that coming to court on his own was not a good idea. He was made to look like a fool who didn't know the law.
Grammy, he lives in FL, and I live in TX. So, on what basis can he fight the modification? His salary has trippled! His son deserves the benifit of that. Isn't modification just number crunching? Put in the new numbers, spit out what the child support should be. That's why I thought it was anyway. |
