I am New to SFV |
Hey, I am 20 years old with a 4 month old daughter, and my husband and I just split up. I was wondering what I should do and if anyone else has had a spouse from another country. My husband is from Ecuador, and he is there now. I'm not sure what to do, we are not legally divorced. If I divorce him now he will loose his greencard, and will probably have to stay in Ecuador. If I divorce him and he is out of the country will I be able to get child support from him? I assume the court can order it, but if he doesnt pay, not much will happen. If we stay separated until he comes back to the states and then divorce when he is a permanent resident I know I can get support, but I worry there will be a messy custody battle. Anyone have any suggestions?

I do actually have some experience here. My best friend is Australian. She left the US, and is living in Australia now due to domestic violence in her marriage.
Research and see if Equador is part of the Hague Convention. If it is, you have a better chance of being able to get your child support even though he's outside of the country, and the reach of American law. I'm not saying you'll get it or anything, just a better shot. If Equador is not part of the Hague Convention then you need to weigh the options of waiting to proceed with the divorce or not. American and Australia are both part of the Hague, which is why I know all about this! |
