Typically, only the biological parent's income is considered in calculating child support.
Of course in a typical marriage funds become mutual so you might consider that the new spouse paying child support....but their income should not be a factor in how much is being paid. |

oh forgot to say that he has family that even say they know and have been told by the mother of his child that she didnt want to put him on child support because there were several times she could of but she always said no she said she wouldnt do that to him but i feel once she finds out after like 4 years of them not having anything to do with one another, if she finds out about me and our child that she will all of a sudden try and force child support on him now which he says isnt a problem he will pay its just she told him she would never put it on him and even told other family members of his also. So i was just wondering incase just a heads up thanks for all the advice and information

I have posted on this board before to give others the chance to see me going through a modification and to also, of course, get advice. Well here I am again and as I suspected the NCP is asking for a remodification of the 11/2006 modification we just went through. He claims he has had a significant change in his income. I do not really know the terms of this significant change, but he has made well over $100,000 in 2001, 2002, and 2003. He made over $60,000 in 2005, but he is claiming he wants the child support dropped from $700.00 now to $300.00. He also now has his girlfriend and her two young children living with him; which I am sure he wants to stay around home more now. He is self-employed, of course. What will the court look at and what can I do other than providing proof of his past wages (which I found over the internet)to prevent his child support from dropping significantly. Should I mention that his girlfriend is living with him as I know it will not matter in terms of support for his child, but I do think it matters in that he is working closer to home now. What do I do? Any advice from anyone would be greatly appreciated. Thanks so much! |

here goes my story i used to live in az and have 2 girls their mother now owes me child support and has just sold her house she owes current and arrears will the arrears be paid when the final papers are signed? the second case i have a son robert 24 he lived with me since he was 16 and worked with me in az he went back to his mothers at 18 i have sent the paperwork from the place we worked and his license had our address and his mother was collecting welfare and now they say that i owe 24,000 in arrears and they also have another child on there that is not mine i wrote child support and they said that i would have to get a paternity test on both boys and pay for it out of my pocket and i am barely making it now with a 16 year old daughter i have even written the governer of az and nothing seems to get done the interest is around 19,000 and i will never get this paid off please help i now live in illinois

I have done everything to enforce the court order, and get a new case worker. I have written letters to the governor, and my legislator, requesting a new case worker, and enforcement on my case since the past due was a little below $15,000.00, but they have done nothing. Now the Non-custodial parent has filed for a modification to reduce the amount he is ordered to pay each month, so they said I can not even request enforcement until after the court date which is in December.
The total monthly obligation owed is $503.00 The current balance owed for this month is $503.00 The total balance owed is $21,550.57 How can i get the court order enforced? They refuse to do anything. Is it true that it is easier for them to go after NCP's that do pay as opposed to the ones that don't? All enforcement options that do not include jail time have been exhausted. Leanora Castillo |

So, here goes...
Currently I have a child support agreement with my ex that is nearly five years old. He has paid the same amount (which is modest, to say the least) for the last five years. Recently, I ran across an article in the Wall Street Journal profiling him and his company. The article listed his companies earnings as "10 million dollars in projected sales for 2007". This same reporter also profiled him in another article (a completely different subject) that included the following information: "company revenue of ATLEAST 1 million dollars is required for membership". In both of these articles he was listed by name and one included a photo. This is the problem: I would like an upward modification of our current child support agreement but my ex keeps claiming a personal income of only $56,000. He is the Owner/CEO & President of this company. No partners. I know that he is lying. But our current child support agreement has a stipulation that I can't seek an upward modification unless his personal earnings exceed $85,000. I'm concerned that if I go back to court with nothing but these two articles in my hand, that the judge will laugh me out of the room. Can someone please offer a suggestion/some advice. This matter is being handled in a court in New York state. Thank you! |

His assets count as income, just like if you owed a house you couldn't get benifits from the state!
You can file for a modification two years into the child support order, andevery 4 years after that. A judge will decide if you get your day in court or not. It can't hurt to file, and his income has increased dramatically. Bring the articles with you to court as rebuttal of his income. Also request the judge to go over his tax returns, and assets. |
