I am a single parent. My son's father (8 y.o.) has not seen his bio father since he was 2. My son does not remember him. My ex paid his child support for 5 years. 3 years ago, I told him he could stop paying. I was making very good money at the time. Also, I was grateful that I did not have to go through custody battles that I hear about all of the time, so I was happy to simply have my son to myself.
My financial situation has changed. I have written to my son's bio father and asked for the payments to start again. He had me sign a statement saying that the payments would stop. I'm wondering how signing this statement will affect me legally in the event I have to use CSE to get the child support.
Also, I hear of stories where fathers come back after 7 or 8 years and want custody of their children. How likely would he get custody (in the unlikely event) he would even want custody. I'm probably just paranoid, as his bio father is sort of a "playboy" type and has not been interested in a "family" type situation before. Any advice?

Hi,The best thing you can do is to consult a lawyer.
Do you have a copy of this contract?
I would have it checked out for it's legality incase it ever went to court.
