I am New to SFV |
hello all. try and follow me on this one. a few months ago i was laid off from work. about a week later i got a new job that pays much much less than i was making. i filed a support mod that failed to go through. heres my problem. upon any job changes i make sure to let the proper child support ppl know what has changed. my employer has submitted all the correct forms to the state in order for them to garnish my checks. well its been 3 months and the state still has not taken any money out of my checks. i have called the state and have talked to my boss about this. my boss has also talked to the state to figure out why they havent taken anything out yet. well come to find out they messed up my paper work and it got lost in the system. to date, i have over 1800 in back pay that im responsible for that i thought was being taken care of due to all the mix ups. well two weeks ago my boss finaly talked to my case worker and figured eveything out and the both of them said everything would be fine. well yesterday i got a notice that my drivers licenses is going to be suspended due to all this ****. whats going on? i thought everything was ok? any advise?

You know, that is beyond annoying. Here you are a parent ready and willing to pay child support and TRYING to pay it and this bs happens. Do you have an attorney? Do you have a lot of this in writing via letters and such? If not document it all and ask your boss to do so as well to cover yourself.
Are you in touch with your ex? Would it be possible to get the orders changed so that you make the payments yourself and then you don't have to deal with this confusion anymore and your ex would actually receive the child support. |

The driver's license notice may have just been part of an automated process. I would suggest calling your caseworker again and let her know you got the notice so she can expedite clearing up the matter. And, like it was mentioned before, document everything.

That's because even though you were waiting for them to start the wage garnishment you are ultimately responsible for making the payments on your own if need be, just because they weren't garnishing your wages is no excuse to them for non payment, aggravating but true. They know that you know you are responsible for paying it and the system does take a while to kick in wage attachments sometimes, but they also expect that payments are made anyway in the meantime.
You should be able to get the driver's license squared away fairly quickly. Call the caseworker and talk with them, you may need to send them some sort of lump payment (maybe even a partial of the arrears) in for them to release your license but they should do that right away for you. You should be able to reach an agreement with the caseworker on how much they need for them to issue that license release. Been there/done that |

Now, question. (I'm clueless as my ex pays them on his own for various reasons.) So, if one was paying on their own during the time the system was catching up, how would the "system" know they were being paid?

Sue, a record of the payment should be sent to the agency, so they can update their records.

Oh, just to add....If they lowered your payments for you for the new job, count your blessings. Years ago I had my child support amount based on a job that paid $2 more an hour than my regular income. I only held that higher paying job for 1 month and went back to my previous job, but they decided that I had the ability to make that extra money and reflected that in my monthly payments.....

That is one thing I can't get Mike to understand...even tho he has given the info for wage garnishment, and takes a while for AG to start takin it out...that he is responsible for making those payments til it kicks in. So he just keeps gettin further n further behind.
I now know what kind of money Mike makes...and I see no reason Y he cant in 2 or 3 months time send in that extra money to get caught up!! So from now on laybac....when you change a job keep in mind to save the money to pay ur CS on ur own. That is until info from the new job has kicked in and CS is being taken out. |

hey thanks for the reply. i forgot to mention that there is deductions from my checks. apparently they are going to the wrong place. so im really confused on whats going on??? ive always kept up on my child support payments til this ordeal. i dont wanna loose my licenses.... im kinda stressin out here.
i have faxed the check stubs to my case worker...no reply on that one from her. as far as the problem goes, it "was" to be already settled. at least according to what my boss and case worker says. IF that was the case why am i gettin a notice in the mail about my licenses outta the blue? anyway, thanks for all da advise. im just venting out, sorry. please dont get me wrong, im happy to send mony for my kid always have been, but the "system" is harsh. |

Something definitely isn't right here. The state doesn't take the money out, your employer does and then sends that money into the county that the court ordered wage assignment is filed. If he's been taking those deductions out than he should have a court order with the proper address for mailing those payments, and he also should have furnished you a copy of that order as well.
At any rate, if your boss who is sending those payments and the case worker who is tracking those payments are telling you it'll be alright, then you need to find out from them exactly why it's going to be alright. Is this money accounted for now. Your case worker is the one that puts into motion the release of the suspension of your license. So be sure to talk directly with your case worker and as long as your accounting snafu is being taken care of, then the case worker should easily enough remove that hold on your license. That's the next step, is make sure you talk directly with your case worker about this. |

well i tried to call my case worker 2 times and still no call back. i heard through a source that the mother of my child went to see my case worker last friday. from what i hear they are going to hold me in contempt of court and now im looking at jail time on top of the licenes thing. man am i stressing out here.

Don't stress too much...if you have all of your ducks in a row, that courst "should" catch their mistake and correct it. Especialy if you heed Sue's advice and document..document..document..
Give the caseworker a little time to get back with you too, it is Monday and they are most likely bogged down. Also, in the future,if I were in your boat I would pay close attention to my check stubs to make sure that the employer is garnishing your wages as they are supposed to. If you notice that they are not withholding then notify them immediatly so that you don't have to go thru all of this again. |

ok what an ordeal! well my case worker finaly called me at the end of the work day. i explained myself to the fullest and what is going on. she said that since my job change there has not been any money given to them from my employer, but there are deductions on my checks. go figure?! so as we all know, im fully responsible to make payments no matter what. well i was totaly under the impression that the money was being sent to them due to the deductions. i guess i cant think that way anymore, pfftttt. so anyway, she is to call me back tomorow to find out how much i need to pay in order for me to advoid the licenes thing and the comtempt of court thing too. ill tell you, you cant put total faith in the "system" to do what you hope them to do, like they should. sorry im venting again. anyway i hope everything turns out ok.
