Why is the child support system not going after my ex as they're supposed to? He owes a little more than $16,000.00 and up to this moment hasn't had a motion to appear before the judge for contempt. How can I push this along? It's been two years now and all I get is the bueracratic (sp?) runaround from CS. How can I have the judge look at this case and file a contempt?

what does your attorney say? If you don't have one it might be time to get one.

Hey Flgurlie the state of Fl doesn't have an Attorney General?? If so, they will handle ur case as far as child support and insurance. You can also look on the internet and there are different organizations that will help you collect. Its worth a shot.

And anyways I have heard Florida is one of the worse state for the NCP to owe money to. I have always heard they were pretty strict on deadbeat moms n dads. Is that not true???

Yes, they have a state attorney, but the system must be bogged down with so many cases like mine that it is full of bureaucratic red tape. I just found out that they sent him an address verification letter and it was returned to them, they wouldn't tell me the two addresses they sent it to. I asked if it was the one address I had on him (which they've also had for over a year now) and they told me NO that address does not appear in our database. Oh it made me want to scream.... I'm like OK, so what address did you send him the notices of his court date in July? The girl couldn't tell me. I gave her the correct address and told her to send the letter to that address, but now it's a whole 'nother circle of things that have to happen. That is all my case has been, just one big stupid circle (can I say stupid on here?). Can you tell I'm frustrated? This week I couldn't afford breakfast or lunch for one of my kids (he's in a special program that doesn't provide transportation, breakfast or lunch to the students)... I only had enough money to buy dinner and to put gas in my car. It breaks my heart to know that he's sucking it up.

I know the frustration! I've been dealing with the DOR in Mass. It's been 7 years of bull. They've revoked his license but he just drives anyway. He works under the table (I've told them who he works for). They keep saying (only because I bug them weekly) they will "look into" filing contempt charges but they don't. I did pick up a very good tip on here though, that I previously didn't think about. I'm getting ahold of the IRS. I hope they will be interested in knowing he is working and not paying taxes. My youngest is now 17 and I have given up on ever receiving help from DOR. I've decided to call the child support network and see if they can bully him into paying something. I know they will receive between 25-34 percent of whatever they can get out of him but I figure anything is better than nothing.

I forgot to add one more thing. If these state enforcement people would file contempt on these deadbeats I bet a lot of them would pay. I know my ex would find the money if it meant avoiding jail time.

Hey olive, there has been a contempt warrant on my ex since July 5 and has only made a few payments.

Research on line - I have heard there are non profit groups that will take up the fight for you. Don't know any myself but try it. I am so scared that my ex will stop paying, I hope that when I need help, it will be there.

Contact CSE and tell them you want them to do a LAR (Legal Assitant Referral) to the States Attorney to bring the deadbeat back into court on Rule to Show Cause (find him in contempt of a court order to pay support) Call them but follow up with a letter so you have written documentation that you requested this. If the judge finds the db in contempt he can order him to jail and make him post a bond (amounts vary with judge) once the db post the bond it should be released to State Disbursement and then past on to you as payment of arrears. Try to attend hearings/court dates. Talk to the states attorney before court and ask him to ask the judge to do this. If your ex owes arrears and is not paying and owns property have a lien placed against that property to ensure he can not sell, transfer, refinance until the arrearages have been satisfied.
Has a order to withhold been sent to the employer?

It's a free service and almost every county is overwhelmed with cases. They are understaffed and underfunded. That's the reality of it.

A contempt action in California only requires that the Plaintiff show there was a judgment for support, Defendant knew about it, and failed to pay. Burden shifts to Defendant to prove inability to pay. That is easy to disprove in almost every case. Defendant could have paid something toward support instead of paying cell phone bills, cable, etc.. In CA, 5 days in jail for every month Defendant willfully failed to pay. You need an attorney if the County won't do it.

I'm in Florida and from experience I know that it's great for the non-paying NCP. For ten years now, all they have done is send him past due notices.

It seems as tho at one point or another most single parents are in the situation fo not recieving support. My son's father has my son who is going to be 4 in Jan and a daughter who is going to be 5 in Dec. Between myself and the other mother he is over $16,000 in arrears. He has been to jail once for 30 days on her case and in mine they just keep telling him he HAS to pay......yeah right. Now the last time we went the gave him a suspended jail sentence of 30 days if he did not stay current with his support for 3 months. Wel big surprise he didn't. Now he is in jail on unrealted drug charges and no one will tell me when he is getting out. They would not transport him to our last court date ( have been to court 4 times in the last 3 months) so all they would do is file for a warrant and send it to the jail that in hopes when they release him they will re-arrest him on that warrant. The only problem with that is that once they do have in coustdy and bring him to court they are going to call me one Tues morning and tell me that I have to be in Boston (I live almost 2 hrs away) This means that my son is going to have to miss school, I'm going to have to miss a day of work and I'm going to have to pay extra in child care......and hes NOT going to get the 30 days that he was told he would last time, cause he just got out of jail. Therefore its proven that he has money to buy drugs but not to support his child and he is going to get away with it again. Anyone from Mass that can give me some advice I'm open to it.....PLEASE!!
