I am going thru the whold child support issue. My daughter is nine. And her father is a detective in NY. After two years of battling with the courts I finally have a temporary order enforce for 130.00 a week. Of course he has not paid on this temporary order and its been 9 weeks. We have another court date scheduled for a trial. Because he could not agree to pay what his daughter is entitled. My question is, he earns about 90 thousand a year. I earn less than 30. He does pay child support for other children he has and according to the documentation he pays about 3000.00 a month. He now claims that he no longer has any money and that he can't afford to pay the 130.00 a week which is only $520.00 a month. So we are going to trial. Am I going to get stuck with 50 -60 a week when he makes three times as much as I do. It's not a money factor with me but I feel my daughter should be able to have the same life style his other children have. Roll Eyes

Hi,
Assuming it is similarly done there, each new child support order generally ends up being a lesser amount. They look at existing orders as part of his income/expense declaration and then base the new child's support order accordingly without modifying previous support orders for the other children. Basically the newest child would receive less money than the ones already receiving support. He does have the right to ask for a modification of the existing orders himself where they would review his latest income/expense including the new child support order and then "possibly" reduce the amounts in the other cases.

in NY state you get a percentage of his pay no matter how much he is already paying out. doesn't matter how many kids he has with different women. can't remember the amount for one child but I think it is 15% I know 2 children is 25%.
