Does anyone know the answer to this? My soon to be ex is saying that it isn't included and that my lawyer can't touch that but yet the reason he is getting it is because of me and the baby. How can I find this out? He is on recruiting duty so he is getting a special duty pay as well.

I would talk to the recruiters office or his commanding officer. As I know it, the law states that all income is used in determining child support. If someone else knows differently, please correct me. I know that bonuses and commissions are included because they are income.

Hey Stephanie,

Yes you(because you were married) and your kid is entitled to all of his gross income including his BAH. If he is claiming the kid and you as a dependant then he'll get more money for his BAH. See if you can get a copy of his LES. Also try to go on base or contact family services they should give you a run down in what your entitlements are as well as an instruction on what his obligation as a service memeber is to support his child and spouse. That will include min requirements to pay for child/spouse support. I know the Navy has an Instruction not sure about the Marines. Once you show him that instruction have him kneel on his knees and pop open the lid...maybe that will get it into his head Wink ( no offense to anyone Smiler just a joke between us navy "squids"..cough cough and our lovely marine "jar heads" Smiler )Hope this helps and take care...

My soon to be ex husband is in the army and also a recruiter. I recently just spoke with a lawyer and I was informed, yes, BAH and BAS are included in determining child support payments. The special duty pay is also included. I'm not sure if where your husband is stationed they get incentives, but mine gets a lot of incentives for how many recruits he puts in and unfortunately that is not calculated in child support.
