I am planning on taking the kids out of state for a week vacation. There is nothing in our orders that say I can not. I am just wondering how much notice I have to give to him? I am worried about giving notice to a man who does not schedule time to get his kids and can not show up when he says he will. I just want to do things right.

Even though there is nothing in the Court Order specifically stating that you should inform him that you are planning to leave the state, in most family law it is an underline law that you must inform him. If you don't you could be charged with kidnapping. My fiance and I are taking his kids away for a weeks vacation and we inform the ex. Although she never informs us she is going out of state we do so becuase if somehting were to happen like a plane crash, car accident or any type of misfortune the other parent can claim neglect and get parent of primary residence taken away from you. At least that is how it is in the state we live in.
