I am currently going through a divorce. I first contacted an attorney last November. A court date has yet to be fixed. My ex wasn't served until last March.

I guess my question is---is this normal? Do attorneys really take this long? Our case is very simple. I'm thinking it's just I'm too nice and need to start calling the attorney's office every other day.

I think it all depends on the complexity of your divorce and whether anything is contested or not.

Myself? I went through a paralegal and was divorced in 45 days. That was it.

No, mine was lengthy, too. I think it was at least a year, which was completely ridiculous, because we had a relatively simple split, too.

I think it was a way for my idiot attorney to legally rob me.

Sounds like paul's got the right idea, going the speed route with the paralegal. Next time I get divorced, I'm trying that method. LOL Tiffany

If it's a simple, uncontested proceeding, you might be able to do it yourself and save a lot of time and money. I'd be calling the attorney and finding out why you haven't gotten a court date in almost a year. That's ridiculous.

In most states, if the other party hasn't filed a response in a certain length of time (usually a month or less) they have basically waived all rights to contest.

If your attorney isn't keeping you informed or even taking action, you need to find out why.
