HOW WOULD I KNOW IF I HAVE TO GET A DIVORCE OR NOT. THE FATHER OF MY CHILDREN AND I NEVER MARRIED BUT WE HAVE BEEN LIVING TOGETHER FOR THE PAST 5 YEARS ON AND OFF AND ALL HIS MAIL GOES TO MY HOUSE. WE ARE SPLITING UP AND A FRIEND OF MINE SAID WE HAVE TO GET A DIVORCE BUT I AM NOT SURE THAT IS RIGHT OR NOT. I HAVE CHILD SUPPORT ON HIM FOR OUR KIDS.

I'd love to give you advice, but so much is different here in Canada that I'm sure I would give you the wrong advice.
I would guess that you don't need a divorce, but legal proceedings would be smart as you and he are liable for your debts adn whatnot the same as a married couple...

HI Jenny,
I don't think you have to but just to make sure call your local court house. It depends on your states common law marrage law.
Normally you have to have a marrage certificate in order to get a divorce.
