I am New to SFV |
I was wondering how hard it was for you to get custody of your children? What were some of the circumstances that enabled you to get custody? I don't know of any guys in my area that have gotten custody to ask them questions. My boyfriend has a beautiful little girl who he adores. He is considering his options regarding custody b/c his ex has issues. If you want more details -read under law/legal...

peachy, I have read your other post. For what it is or isn't worth, based on what I read, your bf would probably have a difficult time getting custody. Usually for a custody change, there are more severe circumstances involved.
My example is this. I got custody of my daughter after picking her up from the local PD. Her mother was charged with child endangerement. CPS turned my daughter over to me and I filed for custody the next day. I also had gotten school attendance records from first grade and the first half of second grade that showed a very large majority of school days were either unexcused absence, or very tardy. A progress report that reflected she would be in danger of being held back due missing so much of the class that she could not help but be behind. I had no real fight in court. With those charges, that she plead guilty to, and school records it was a simple case to show her as unfit. Truth is it still would not have been as easy as it was for me had her mother put up any sort of fight. It would have at least taken longer had she not simply agreed in court to give up custody, making it even easier for the judge to order the custody change. Otherwise we still would have been required to attend mediation as the next step had she put up a fight. While I'm absolutely sure in the end I'd have still been granted custody, it could have been a longer struggle even with these circumstances. |

Thank you for the reply. There are a lot of people in our community that want my bf to get custody of his daughter b/c they know the girls mom and the issues she has. I/He is worried about the daughter's safety/stability. Also, there has been another change in plans. The girls mom got married, then was going to get divorced... wasn't sure where she was going to live... is now back with her husband who she claims beat her up. All in all, I think beings that she is married- my bf will have a hard time in court proving she is unfit. She does have court records for drinking, but none where the daughter was involved. And as far as her getting beat up, its really unknown and I know our court system around here will not pull a child from a home unless there is proven abuse to the child. Thank you for sharing your experience... I will pass on the message to watch how many days of school are missed. That is one I didn't know. Thanks again.

Luckily for me the mother left me with the kids. If she put up a fight I'm 99.999% sure she would have won in court. I told her she would not have to pay support if she gave me custody and she agreed as long as she kept 50% legal custody. Shortly after the custody stuff went through the court she left to live to the other coast. I think it would be much tougher if there was a court battle.

Hi,
I have custody of 3 girl's.My ex and I split a year ago this Friday(15/11) and I have been raising the girl's ever since.There were issues of Emotional Neglect and other issues and on 17/09 I went to Court and was awarded Full/Sole Physical Custody and Sole Residency for the girl's until they reach 18.It was already agreed beforehand and there was no contestation. Peachy, Best advice i can give you... get a REALLY big calendar, start writing down the days and times of antyhign that seems bad, odd or just plain weird. When i went before the Family Court judge here in Texas with that calendar it helped tremendously to make sure that I got custody of the baby after my ex left me.
Best other advice i can give you... Get a lawyer, dont do anythign without a lawyer. Best question to ask a lawyer... "If i was going to hire anyone other than you who would it be.." and give that question to several other lawyers too.. see who's name comes up the most. Good info to have. |

I got custody because my daughter's mother abandoned us and signed over her rights.
Two years later, she tried to get custody, but since she signed over her rights, it was foolish to even try, and I was awarded full custody again. |

Depending on what state you are in you really have to be a real mess up of a mom to lose primary custody of your children. I have costody of mine cause my x wife left the state to be with another guy and left the kids with me. I filed for divorce and she never argued the costody part and hasnt even tryed to see them in the last 2 years. one of them isnt my real son he is my x step son but he dont know that so shhhhhhhhh. lol i do have leagle gaurdianship of him though
