Default The slow system

I got a call from a single mom who is trying to collect child support from one of our employees. We got a letter from the child support enforcement people end of January 2009 requesting wage information. We answered it the next day. We still have not gotten an order to garnish his wages. I feel so bad for the woman, but we can't just randomly garnish his wages, we don't even have an amount. Unbelievable it is now August and nothing has happened since we responded.

ironically, i agree that it's crazy that the process takes so long...there are issues with the system...they need to be addressed, not expanded and perpetuated...

I am going through the same thing right now with the father of my oldest. I got a letter in Jan '09 that they were raising his cs for the first time in 10 years. I thought great, woo-hoo! I called CSRU June 20th and asked them why the amount that is garnished hadn't been adjusted, they told me that they would contact the other state and find out what was going on. I called last Friday and found out that they didn't send a letter to the other state until July 29th. When I asked them why it took them a month to get a letter sent she just stammered and then tried giving me the excuse that it takes a while to get things like that put together. I laughed at her and said well from my experience with your agency form letters are all that you ever send and to me it should only take 5 minutes to change information and print one out. They irritate the he!! out of me.

I already did. LOL! My oldest is 13 and his father didn't start paying regularly or even close to the monthly amount until 2-3 years ago. He owes me over $20,000 in support.

Thats why we just have to stay on top of it. I would tell the lady to bring the court order herself to his job that way your company can move on it. They might want to adjust someting but idf there isalready an order than until a new one exists that is what he has to pay. I did this at my ex's job. Then I went to the CS agency and told them I did it. I got a check within 3 weeks. We just have to be persistent.

I don't know if she has gotten an order yet. She was calling to see when we responded with wage information. They told her we responded late May. I have a fax receipt it was sent January 26.

Yeah, she asked me to look and see if we received anything. Honestly I had to go look back in his file to find it. I forgot about it it has been so long ago. I found it and the fax receipt I attached to it and read her the date. She laughed and told me what they told her. She asked if I could start cutting it, she really needed the money. I sympathize, but i can't just garnish somebody's wages because someone asks me to.

Yea....an official court order of wage garnishment has to be sent to the DOR with the exact amount WITH the judge's signature and THEN the DOR sends it to the employer. I believe I first served him Dec. 31st? Someone could look back on my threads and see and my first check from him via DOR....STILL hasn't been directly from his check, but from him sending in checks to the DOR who in turn send them to me. They aren't regular yet, but HOPEFULLY getting there??? I've spent (or owe) a lawyer thousands and we aren't done yet. Without a lawyer it would have taken an even LONGER time to get this all rolling. AND the DOR keeps making errors....first sending the wage garnishment to the wrong employer??? Bunch of morons. Really.

My ex owed me over 10 thousand and went before a judge 3 times for contempt. Each time he just cried and had to pay on time for 6 months. Never even got his license revoked or anything. After the 6 months he would stop paying again and after a year or year and a half the would take him to court again. Guess I did get it regularly. Every two years I would get 6 months of payments...

Yep, if she personally handed your company an order, you could not just withhold. You have to get the garnishment FIRST.

Recently, I had a friend that went to small claims court and received a judgment against someone. They then went to every bank in town with the judgment--spent 2 days doing it, and bingo found the bank. Took every last sent out of the persons savings and checking. You can take the judgment to the bank, but not to an employer....go figure.

The system is messed up. I feel sorry the most for parents that are dealing with collecting across state lines.......that's an almost impossible task.

It seems like it takes forever to get my state to do anything with my case because it involves the state of Texas. Every time I call to find out what is going on with the insurance cards that I was supposed to have sent to me, or with the support they tell me that they will send another letter and it will take up to 8 weeks until they get a response from Texas. 8 WEEKS? Are you kidding me? It takes 4 days for a letter to get here from there, what is the rest of the time needed for? About 5 years ago I got fed up with talking to my state and hearing the same ____ every time, so I called the attorney general's office in Texas. I called every other day for probably around 6 months and always got the same response, they can't give me any information I need to call my own state. I even had one lady tell me to get a life. LOL! It just frustrates me that the whole time he was supposed to be paying me, he partied his ____ off and got to finish college while I struggled to give my son the things he wanted.
