humm Sentencing- what happens?

Does anyone know, if the ex is sentenced, if he will straight away serve his time starting right then??

Curious as I am formulating what to do.

Exie is being the picture of courtesy and nicety right now. It's shocking.... and I am sure there is an ulterior motive. It just hasn't reared its head yet.

Here anyway, they are hand cuffed right there in the courtroom and escorted to the jail house.
From all the times I have been in the courtroom, if a purge was set, and they didn't comply, they are always handcuffed and begin their sentence immediately.

The difference between here and there, it seems, is there is not a court date, typically anyway, once a purge is set. They are given a deadline in which to comply, if they don't, a warrant is issued for their arrest, which can take weeks/months to actually be enforced.

I bet the Magistrate or Clerk of Court could answer that question for you

I might ask the clerk. They are reticent to answer me as a general rule on legal things though. I may ask my lawyer but I have a tab already with him that I need to pay.

The Clerks here are very...forthcoming at times. Thou the answer is usually very general since one cannot really know what will happen for certain. But they usually have a good idea based on what they see.

Here, if you sit in CS court, you can get the feel of the day as soon as the Judge walks in and begins speaking There are more "Hope they have enough handcuffs" days than not - generally speaking based on the amount of people in CS contempt court on any given Mon or Fri.

We have hearings here to. They know if X amount is not paid by that date, to prepare to go to jail.

Cf -- what does your states law say about it. The 9th circuit court is not going to influence your area as much. And the 9th circuit is a bit of a rogue court anyway.

I hope they take him away as WS described.....R and yourself have endured enough at the whims of this guy.
I hope also that if he were to come up with enough money by then to get off the hook that some means are set up to ensure this is not just part one of an upcoming sequel. The child suffers so much and the ex seems to get all the second chances.....

Oh I know LSL. I just liked the verbiage, came across it as I was researching to see what would happen.

ORC is vague. Just says they can serve a term of imprisonment. I would think he'd go straight away at sentencing.... but I can't find anything to corroborate.

Might have to get on the bar association site.

Muskie, I couldn't agree more. His attitude more than anything else drives me on this. He truly seems to believe he should not have to pay one red cent for anything for R. The last time I saw support of any kind, he bought him snow boots in September from Wal-Mart for around $20. R needs so much so constantly and it's not fair that he wants to be involved, but not have to take any responsibility.

Sadly muskie I do not think this will serve any purpose other than making him angry. At this point I have to believe he just wants to appear the victim of me, the evil witch asking him to abide by a court order to support his son.

I would drop support if he would leave R alone, but that will not happen. So, if he wants to be a dad, he WILL be held accountable for ALL aspects of being a dad.

If I got that arrearage, I would put it straight into R's 529. By the time he was 18 I would think it would make quite a nice college nest egg!

I have considered sending soap on a rope.... but.... that would be very petty of me.

He has taken vacation time and everything like he thinks he will not be in jail. It shakes me a little- we shall see what happens.

He has slipped away so many times I don't have much faith in him getting caught now.

So Exie just called with a sob story. Apparently I have “forced” him to put his house up for sale and if he goes to jail, both of his houses will be foreclosed on. (Woe is he, two houses!). He claims he paid my unreasonable support rather than pay his mortgages for 7 months- right, where can I get a $20 mortgage- and it’s “not fair” he has to pay a higher cost of living for R because I live in an area that is more affluent.

I was just like… if we can give R the best why shouldn’t we? He claims where he lives is just as good (it’s not). I was like well I’m not moving and this is where R lives so not sure where this is going. He replied he believes he should only have to pay what he would have to if R lived where he is at…. (what?)

So now he is crying about having to go live with his sister and says he is putting his house up for sale (no listing yet… so).

I feel no sympathy. I just said… do you think it is easy to pay for everything for R and a mortgage and a car and everything?? He just said I’m choosing to live expensively (expensively! Ha!)

Muskie I just choked on my morning juice at work. DYING. That was hilarious..... oh my gosh.

I think he is just practicing his sob story for the judge. I really have no sympathy, not sure why he expected it!!

Hopefully he will go to jail for the rest of his life and die there. At least in the mean time you will get $10 a week or so from the job he gets washing dishes or working in the library.

No, hopefully jail is the motivator for him to support his child aa I know he can. He just refuses to work. Thanks for the snarky comment though.
